Photographic Services Terms and Conditions
The photographer will do her best to produce the output agreed in the contract and fulfil special requests for photographs. Failure to attend or arrive within a time constraint or other prearranged limit will be rearranged at the cost of the photographer. Non-attendance of guests or failures of suppliers not in the control of the photographer may incur additional visits and reasonable charges may apply.
Permission to photograph guests and other individuals (celebrants, venue staff) is assumed and any exceptions should be advised clearly in advance. No responsibility can be taken by the photographer for non-compliance/cooperation of the individuals being photographed. All reasonable steps are taken to encourage reluctant people, however the photographer will not force an individual to be photographed against their will.
The images provided will be of a professional standard colour balance and brightness, the appearance of which may vary according to the equipment/media on which the image is printed or displayed. Standard retouching of images is included. Charges may be made for further, complex edits (such as swapping elements from other images, extensive skin retouching and colour/background changes etc ) made at the client’s request, these charges are pre-agreed prior to work being done.
Limitation of Liability - In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. In the event of illness or situations beyond the control of either party resulting in the work not being able to take place on the pre-arranged day, all efforts will be made to reschedule, or to find a replacement photographer if the date is specific to other events and not possible to reschedule. The photographer will abide by the current government guidelines for events and is entitled to withdraw services if laws or safety guidance are not observed at no further cost to either party.
Display/use of images
The client may display on their personal websites, devices and social media and incorporate images in other products for non-commercial use eg. commemorative products. Where digital images have been supplied, the client may print for their own personal use or for gifts. Images will retain the credit of the photographer.
Permission from the photographer is required, and may incur a charge, for use of images in publications which are sold, online or in printed materials such as books, ebooks etc.
Permission is granted to the photographer to display all images created under this agreement online and printed for professional samples, websites, advertising, exhibitions, competitions. No use of images will be made by the photographer for 3rd party use, or in products which are sold except with prior permission of the client.
Copyright and Data Protection
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of the photographer/s in writing.
The Photographer is required to hold client data on file, in order to carry out this contract, and may make contact by email, phone or post. Appropriate ICO registration is held by the photographer. No client details or images will be provided to any 3rd party without prior agreement from the client.
Payment Terms
Separate invoices will be sent out for each payment.
Non-refundable deposit of £100. The date may be moved if government guidelines require the event to be reduced from the intended format or stopped completely.
Initial payment is due 1 week before the wedding day and is 50% of the intended package. This can be paid in two monthly instalments if required, by BACS only. Payments are not refundable if the event is cancelled within 1 week of the wedding day unless this is due to government guidelines or mutual consent.
Final balance is due 28 days after the photographs have been presented for approval. This may also be paid in two monthly instalments, by arrangement. Ordering of products will not go ahead until the full balance is paid.
Orders of additional products/prints may be covered by a separate invoice.
Late payment terms of 1% per day from date of invoice may be invoked if necessary.
Any complaints should be advised immediately by verbal communication and in writing if an acceptable resolution is not achieved.
I have read this booking form and agree to abide by the terms of agreement set out in it. I understand that the terms of this agreement cannot be changed unless agreed by both parties in writing. Completition of this form AND payment of the deposit indicates acceptance of these terms.
